Welcome to https://www.exampraxis.com (thereafter the website), an online portal for preparation of entrance exams of medical and engineering, and Olympiads exams, owned by AY Edutech Solution LLP (thereafter we or the entity). The users are advised to carefully read and understand the following terms and conditions (thereafter terms) before accessing/browsing/using our website and service. If you do not accept the terms, then you may not use the website and service. We may amend the terms at any time and revised version will be effective immediately after display on the website.

1. The services are available only to the registered users on a single user basis, for a particular period time, after paying the stipulated charges and abiding by applicable terms and conditions.

2. In connection with registering for and use of the service, you agree to: provide/timely update accurate and complete information about you as requested by the website; maintain the confidentiality of your password and other information related to the security of your account; be fully responsible for all use of your account and for any actions that take place through your account; and be contacted by us via emails, phone calls and/or SMS notifications for verification and communication purposes.

3. The registered users may use your existing credentials to access the website and/ or the Services. In the event any mandatory information is not provided, the registration shall be deemed to be incomplete and use of the service may be restricted or blocked.

4. We employ the use of cookies. By accessing the website, you consent to use cookies in agreement with our Privacy Policy. Some of our affiliate/advertising partners may also use cookies. By using the website, it is deemed that the user has consented to receiving calls, auto dialled and/or pre-recorded message calls, e-mails, from us at any time with the use of the telephone number and e-mail address that has been provided by the user for the use of this website which are subject to the Privacy Policy. The user agrees to receive promotional communication and news letters from the entity and its partners. The sharing of the information provided by you will be governed by the Privacy Policy and We will not give out such contact information of yours to third parties not connected with the website.

5. Use of the service is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If the user is a minor i.e., under the age of 18 years, he/she may use the service only with the involvement of a parent or guardian. The service on the website would be available to only in India. The customers who attempt to register for the Service from outside of India are not eligible for the service.

6. We hereby grant the user a limited, non-exclusive, non-assignable, non-transferable and revocable license to access the service solely for personal and non-commercial use. The Content is licensed, not sold, to you by the content provider. You hereby expressly agree that you will use the service only in a manner consistent with this agreement. Unless specifically indicated otherwise, you may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to the content or any portion of it to any third party, and you may not remove or modify any proprietary notices or labels on the content.

7. The Service and all accompanying materials are protected by the entity. All rights reserved. Access and use of the service does not grant or provide you with the right or license to reproduce, remove, alter or otherwise use any of the copyrights or trademarks or protected materials of the entity. Content provided on the Service may be created by the entity, procured from third party content providers, or sourced from available resources.

8. All content including the question papers provided on the website is provided on an “as is” basis and the entity makes no representation or warranty as to the adequacy, accuracy, completeness, reliability or correctness of such content. Usage of our website or services do not in any manner guarantee achievement of the same or similar percentile, rank or score in any examinations or admission to any educational institutions.

9. The user expressly agrees that any access or use of the website or the service is at your sole risk. The entity reserves the right, in its sole discretion and without prior notice, to modify, terminate, or suspend the service at any time. The entity is not responsible for injury or damage resulting from downloading any materials in connection with the service. The service may be temporarily unavailable from time to time due to required maintenance, telecommunication interruptions, or other disruptions. Access and use of the Service may be unavailable during periods of peak demand, system upgrades, malfunctions or scheduled or unscheduled maintenance or for other reasons.

10. The entity reserves the right, at its sole discretion, to alter, amend or terminate the user’s access to the service or any portion of it, at any time, without prior notice, including for any violation of this agreement, any unauthorised use of the service or assignment or transfer of the rights granted to the user. Any termination by the entity shall not affect any right or relief to which the entity may be entitled, at law or in equity.

11. Any dispute or claim arising from or relating to this agreement or the service is subject to the governing law, disclaimer of warranties and limitation of liability and all other terms. The user agrees to those terms by entering into this agreement, purchasing or using content, or using any aspect of the service.

12. Transactions on the website are secure and protected. The User’s credit and debit card information is not received, stored by or retained by the entity in any manner. This information is supplied by the user directly to the relevant payment gateway which is authorized to handle the information provided, and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with. The payment options are available as per applicability of the relevant payment gateway.

13. To successfully subscribe on the website, the User is required to complete the transaction by making the payment for the services opted for. The confirmation email and invoice will be sent to registered email address. The fee includes prevalent taxes and charges imposed by the regulators.

14. The user is expected not to violate any code of conduct or other guidelines, which may be applicable for or to any particular service; not violate any applicable laws or regulations for the time being in force in India; not violate the terms of service including but not limited to any applicable additional terms of the website contained herein or elsewhere.

15. We encourage the user to read the Privacy Policy and to use the information it contains to make informed decisions regarding your personal information. Please also note that certain information, statements, data and content (such as but not limited to photographs) which the user provides on the website are likely to reveal his/her gender, ethnic origin, nationality, age, and/or other personal information. The user acknowledges and agree that his/her submission of such information is voluntary. Further, the user acknowledges, consent and agree that we may access, preserve, and disclose information the user provides to Us at any stage during the use of the Website. Disclosures of information to third parties are further addressed in the Privacy Policy.

16. Access to or use of the website does not authorize anyone to use any name, logo or mark in any manner. References on the website to any names, marks, products or services of third parties or hypertext links to third party sites or information are provided solely as a convenience to you and do not in any way constitute or imply the entity’s endorsement, sponsorship or recommendation of the third party, the information, its product or services. The entity is not responsible for the content of any third-party sites and does not make any representations regarding the content or accuracy of material on such sites. If you decide to access a link of any third-party websites, you do so entirely at your own risk and expense.

17. This user agreement is effective unless and until terminated by either you or the entity. You may terminate this User agreement at any time, provided that you discontinue any further use of the Website. The entity may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site. Such termination will be without any liability to the entity.

18. All disputes involving but not limited to rights conferred, compensation, refunds, and other claims will be resolved through a two-step alternate dispute resolution mechanism.

Stage 1: Mediation. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party and will be selected at the mutual acceptance of a proposed mediator by both parties. Both parties may raise a name for the sole mediator and in the case both parties accept the proposed name, the said person shall be appointed as sole mediator. In case the parties are not able to reach a consensus within two proposed mediators, the entity reserves the right to decide who the final mediator is. The decision of the mediator is not binding on both parties.

Stage 2: Arbitration. In case that mediation does not yield a result suitable or preferred by any one of the parties, arbitration may follow, the award of which is binding on both parties. The arbitration board shall comprise three members – one appointed by each party and the third member to be nominated by the two appointed members by mutual consent. Arbitration shall be held at Mumbai, India. The proceedings of arbitration shall be in the English language. The arbitrator’s award shall be final and binding on the Parties. If the dispute cannot be resolved by this two-step alternate dispute resolution mechanism, it shall be referred to the courts at Mumbai.

Refund Policy:

The user has to subscribe to one of the single user prepaid plans to avail of the services on the website after completing the free trial plan as described.

We aim to provide the best services at competitive prices in our best capacity. We provide 15 days cancellation option with a full refund of any paid services (excluding Test Papers). The user has the option to cancel the subscription in 30 days with a 50% refund. There will not be any refund after completing 30 days of a paid service.

 

Notice and Procedure for Making Claims of Right/Work Infringements:

If you believe that your copyright work or proprietary/intellectual property rights (thereafter the right/work) have been infringed, please submit your claim using process set forth below.

To submit an infringement notification to the entity, send a written communication to us at support@exampraxis.com and provide the following details:

_Identification of the right/work that you claim has been infringed;

_Identification of the specific material that is claimed as infringing and information sufficient to permit the entity to locate that material on our websites;

_A statement that you believe, in good faith, that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or by law;

_Your contact information, including your name, address, telephone number, and

_A statement that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner; and

It is stated that all users of any part of the entity will comply with applicable laws. However, if the entity is notified of claimed the right/work infringement, or otherwise becomes aware of facts and circumstances from which infringement is apparent, it will respond expeditiously by removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity.
